About our privacy policy

This privacy policy applies to all services provided by ThemePhil. We have taken appropriate technical and organisational measures to protect your personal data against loss or any form of unlawful processing, in accordance with the European General Data Protection Regulation (GDPR).

This policy applies to our website, registrations and our business pages on social media. ThemePhil is not responsible for third-party websites we link to; please consult the policies of those respective parties.

Webshop software (PAMU)

Our webshop has been developed with software from PAMU. Personal data that you make available for the purpose of our services is shared with this party for technical support. Under the data processing agreement concluded with us, PAMU is obliged to take strict security measures and to treat your data confidentially.

Data collection and registration

Registration is required in order to use the services of ThemePhil.

  • Basic use: For an account we only ask for: title (form of address), first and last name, e-mail address and language preference.
  • Trading (buying and selling): As soon as you start trading actively, your address details and date of birth are also required on the basis of the performance of the agreement. We use your date of birth to verify the minimum age for trading and to offer personal birthday promotions (if you have given your consent for this).
  • Legal obligations: For specific services we may be legally required to request additional data, such as a tax identification number in accordance with the DAC7 Directive.

Personal promotions and gestures

ThemePhil wants to offer its members a personal experience. If you have agreed to our general rules and marketing consent upon registration or via your profile, we may use your data (such as your collecting interests and date of birth) to send you personal offers, discounts or birthday treats. You can adjust or withdraw these preferences at any time in your account.

E-mail and mailing lists

We send newsletters via MailChimp. MailChimp never uses your data for its own purposes and secures it in accordance with the EU-U.S. Data Privacy Framework. You can unsubscribe at any time via the link at the bottom of every e-mail. For regular business e-mail traffic we use Office365, whereby confidentiality is guaranteed.

Marketing and partners (opt-in)

If you have given your explicit consent, ThemePhil may share your identification data and specific interests with selected suppliers and partners within the collecting industry. This enables them to send you personal promotions that match your hobby. You can withdraw this consent at any time via your settings.

Payment service providers

We use external payment providers to process payments. They process your name, address and payment details. They do not retain this data longer than legally permitted. For deferred payment (buy now, pay later) requests, the necessary data is shared with the relevant credit provider.

General purpose and retention periods

We use your data exclusively for our services and for legally required administration.

  • Customer profile: We retain your data for as long as you are an active member. Upon cancellation, we delete your profile within 30 days.
  • Statutory administrative retention obligation: On the basis of legal obligations, we are required to retain certain administrative and transaction data; we will retain this data for as long as the applicable period runs (usually 7 years) for the Dutch Tax Administration (Belastingdienst).

Cooperation with investigations

If we are required by a legal obligation to share data in connection with a governmental tax or criminal investigation, we will cooperate within the limits set by law.

Your rights

You have the right of access, rectification, erasure, restriction of processing and data portability. Requests can be sent to info@themephil.com. We will respond within 30 days. To protect your privacy, we verify your identity (preferably via the e-mail address known to us) before providing any data. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Cookies & Google Analytics

ThemePhil uses cookies for optimal functioning:

  • Functional: For logging in and settings. These cookies do not identify individuals, but remember preferences.
  • Analytical: Via Google Analytics we track how the site is used. We have configured this in a privacy-friendly manner: your IP address is anonymised (IP masking), which allows us to count visitors without being able to see who you are.
  • Marketing: Cookies to make offers more relevant are only placed with your consent.
